These General Conditions of Sale apply, without restriction or reservation, to all sales of Beautysane products and concluded solely by the consumer on the website www.beautysane.com. These general conditions of sale apply to the exclusion of all other conditions, including those applicable to sales through other distribution channels.

They can be printed and kept by the customer.

Consequently, the fact that the customer orders a product offered for sale on the website www.beautysane.com implies full acceptance of these general conditions of sale which the customer acknowledges having read prior to ordering.

In accordance with Article L.111-1 of the Consumer Code, Beautysane provides the customer with the following information:

Products

The customer takes note of the essential characteristics of the products he wishes to order.

The products offered for sale on this website at www.beautysane.com constitute the offer of Beautysané. Beautysané reserves the right to modify its offer at any time and to change the list and range of products.

The photos of the products presented on our site are not contractual. However, Beautysane ensures that the photos and drawings faithfully reproduce the product and do not contain any ambiguities concerning the notions of size, weight, quality, etc.

The lists of ingredients used in the composition of Beautysane brand products are regularly updated. Before using a Beautysane brand product, the customer is invited to read the list of ingredients on the packaging to ensure that the ingredients are suitable for his personal use.

The products are intended for people in good health: in case of doubt, the customer is invited to consult his doctor.

Customer

Beautysane offers the sale of its products on the website www.beautysane.com to consumers with the legal capacity to place an order (hereinafter “the customer”). Beautysane cannot be required to verify the legal capacity of each customer.

Rates

The selling price of the products indicated in euros is the one in force at the time the order is placed. These prices do not include preparation and delivery costs, which are invoiced in addition to the price of the products purchased, according to the terms defined below and as indicated to the customer at the time of validation of the order. The prices include the value added tax applicable on the day of the order.
For deliveries to the DOM (Martinique, Guadeloupe, Guyana, Reunion), the prices indicated do not include local taxes, customs duties and VAT that may be requested from the customer at the time of delivery of the order.

The offers presented by Beautysane are valid as long as they are announced on the site and within the limits of available stocks. Indications on the availability of products are provided at the time of placing the order, if any.

Beautysane reserves the right to modify its prices at any time, but the products ordered are invoiced at the price in effect at the time of the order.

Payment


Payment of the order is only made by credit card.
The customer has the possibility to check the details of his order and to correct any errors before validating his order.
From the moment the customer confirms his/her order by clicking on the “proceed to payment” icon, he/she is considered to have accepted with full knowledge of the contents and conditions of the order and in particular the present general conditions of sale, the prices, volumes, characteristics, quantities and delivery times of the products offered for sale and ordered by the customer.
The sale will be final at the moment of confirmation of the order by the customer, without prejudice to the exercise by the customer of his/her right of withdrawal (the terms of which are described below). This order will be confirmed by Beautysane by sending an e-mail to the customer containing all the information previously provided. A second email will be sent to the customer when the order is shipped.
Beautysane recommends that the customer keeps both emails. The customer is informed that the two emails will be sent to the email address entered by the customer at the time of identification, prior to placing the order. Also, in case of error in entering the email address concerned, or non-receipt of the email confirming the order, Beautysane can not be held responsible.

Payment by credit card (secure payment)

Beautysane accepts payment by credit card, Visa, Mastercard.

Security

When paying, the customer is automatically redirected to the Société Générale bank website to make the payment. Beautysane does not have any confidential information on the bank card. If the customer wishes to keep the bank details relating to his transaction, it is up to him to save and print the payment certificate.

Beautysane reserves the right to suspend or cancel any order and/or delivery in the event of non-payment by the customer, payment incident and/or fraud in the use of the site or the payment method chosen by the customer.


Control of the transaction

As part of the service of control of orders, Beautysane may contact the customer by any means, in order to validate a transaction and may, where appropriate, request any evidence deemed useful (relating to identity, and / or residence and / or payment method used). The customer must provide the required evidence within 15 working days upon receipt of the request from Beautysane.
The customer is informed that the delay, failure or refusal to transmit the requested evidence will result in the cancellation of the order by Beautysane.
Upon receipt of the evidence and in case of confirmation of the order by Beautysane, the delay in transmission of the documents requested by the customer will postpone delivery of the order.

Delivery

Place of delivery

Beautysane delivers the products in metropolitan France, Corsica, Martinique, Guadeloupe, Guyana and Reunion.


The products will be sent to the delivery address that the customer will have indicated during the ordering process. Any order returned to the seller because of an incorrect or incomplete delivery address will be reshipped at the customer’s expense.

The contribution to the delivery costs is understood to include all taxes (TTC).

Delivery time

An estimated range of the delivery date is indicated when placing the order. Beautysane undertakes to make every effort to deliver the products ordered within the time indicated. These deadlines are communicated as an indication and a possible overrun will not give rise to any damages, withholding or cancellation of the order by the customer.
For information purposes, and without Beautysane being bound by this deadline, from the receipt of the email confirming shipment the average delivery time is estimated at : 2 to 3 working days in metropolitan France (count 2 additional days for Corsica, Martinique, Guadeloupe, Guyana, Reunion).
These times are for any order placed before 12:00 noon.

The maximum delivery time is 30 working days from the confirmation of the order.

The customer is required to check the contents of his order upon receipt. In case of damage, it is up to him to make reservations on the delivery note and to transmit them to Beautysane within 14 days after delivery, or even to refuse the package if it is likely to have been opened or if it bears traces of deterioration and to inform Beautysane within 14 days after delivery.

This verification is considered to have been carried out once the customer, or a person authorised by him, has signed the order form.

Terms of delivery

The participation to the preparation and delivery costs is from 4,50€ to 24,80€ according to the content and place of delivery of the order. This rate applies to a delivery in Metropolitan France, Corsica, Martinique, Guadeloupe, Guyana and Reunion.

The recipient can trace his parcel through the parcel number he receives by e-mail or, failing that, through Customer Service.
The parcel is delivered directly to the letterbox at the delivery address.
In the event that the mailbox is insufficient in size, the package is given either to the recipient of the order, or failing that and at the initiative of the carrier to any other person present at the address who agrees to take delivery (a neighbor, a caretaker or janitor). In this case, the details of the latter will be indicated on a notice delivered to the mailbox at the address indicated.
When the package could not be delivered according to the procedures provided above, a notice of pending is left by the carrier in the mailbox of the recipient indicating the contact information of the carrier to agree on a delivery appointment.

Any order validated and transmitted to the carrier cannot be cancelled. After reception by the customer, the parcel can be sent back to the warehouse with the withdrawal form, the return costs are charged to the customer. Upon receipt of the package, the order is cancelled and the customer will be reimbursed for the products within 14 working days. The maximum amount of reimbursement of the initial delivery costs will be that of the standard delivery.

Delayed delivery

In case of late delivery (delivery exceeding 30 days), the customer may require Beautysane to make the delivery within a reasonable additional period. If Beautysane has not complied within this period, the customer has the right to cancel the order, unless Beautysane has complied in the meantime or if the delay in delivery is due to force majeure as defined below.

When the order is cancelled, Beautysane will reimburse the customer for the total amount paid, at the latest within fourteen days of the date on which the contract was cancelled. In case of delay, the amount paid by the customer will be automatically increased by 10 % if the refund occurs no later than thirty days after this term, 20 % until sixty days and 50 % thereafter.

Reservation of ownership

Beautysane reserves ownership of the products delivered until full payment of the price.

Responsibility

Beautysane is committed to the proper performance of obligations arising from the contract. However, Beautysane may be exempted from all or part of its responsibility by proving that the non-performance or improper performance of the contract is attributable either to the customer, or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure (eg strikes, accidents, riots, fire, etc.. constituting unforeseeable and irresistible events).
Beautysane shall not be held responsible for any inconvenience or damage resulting from the use of the Internet.

RISK TRANSFER

It is at the moment when the customer or a third party designated by the customer, other than the carrier proposed by the trader, takes physical possession of the goods that any risk of loss or damage to the goods is transferred.

Product availability

We do our best to ensure the availability of products. Product offers are valid as long as they are announced on the site and within the limits of available stocks.
Indications on the availability of products are provided to the customer at the time of ordering. If a product in the order is not available at the time of preparation, Beautysane will automatically send an email to the customer. The customer can then:

– replace the out-of-stock product with a product of the same value (except in the case of a free product);
– receive the rest of your order without the out-of-stock product, the amount will then be deducted from the order total and will not be invoiced to the customer (except in the case of a free product)
– cancel the entire order

Beautysane respects all its legal obligations of guarantees such as the legal guarantee of compliance provided in Articles L211-4 and following of the Consumer Code and the guarantee for hidden defects provided in Articles 1641 and following of the Civil Code.
In case of lack of conformity (goods unfit for the use usually expected of similar goods, which do not correspond to the description given by the seller or which do not have the qualities announced by the seller or agreed with you) or latent defects (hidden defects of the thing sold which make it unfit for the use for which it is intended, or which so diminish this use, that the buyer would not have acquired, or would have given a lesser price, if he had known) of the product and in compliance with the conditions set by law, you must address your claim in advance to Beautysane by mail to the following address:

In the event of a lack of conformity, Beautysane will replace the product with the same or an equivalent product. The replacement will be made within a maximum of one month from receipt of the product.

Beautysane reminds its customers that products must be stored away from heat and humidity and are subject to an expiry date. Products that have not been stored in the above-mentioned conditions will therefore be excluded from the guarantee.

Feedback and exchanges


For a return or an exchange, Beautysane invites the customer to contact Customer Service who will indicate the steps to follow and will issue a return form to be completed.

Return under the right of withdrawal

The customer has the right to withdraw from this contract without giving any reason within fourteen calendar days.
The withdrawal period expires fourteen days after the day on which the customer, or a third party other than the carrier and designated by the customer, takes physical possession of the products.

his decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post, or e-mail). The customer can use the model withdrawal form by clicking HERE but it is not obligatory.
For the withdrawal period to be respected, it is sufficient for the customer to transmit his communication relating to the exercise of the right of withdrawal before the expiration of the withdrawal period.


In case of withdrawal from this contract by the customer, Beautysane will refund all payments received from the customer, including delivery costs (excluding additional costs arising from the fact that the customer has chosen, where appropriate, a method of delivery other than the less expensive standard delivery offered by Beautysane) without undue delay and, in any event, no later than fourteen calendar days from the day Beautysane was informed of the decision to withdraw from this contract.

Beautysane will make the refund using the same method of payment that the customer will have used for the initial transaction, unless the customer expressly agrees to a different method; in any case, this refund will not incur costs for the customer. Beautysane may defer the refund until Beautysane has received the products or until the customer has proof of shipment of products, the date retained is that of the first of these facts.

without undue delay and, in any event, no later than fourteen calendar days after the customer has communicated his decision to withdraw from this contract, this period is deemed to have been met if the customer returns the products before the expiry of the fourteen-day period.
The customer shall bear the direct costs of returning the products.


The customer is only responsible for the depreciation of products resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the products. All products must be returned to Beautysane in their original packaging and condition. Beautysane will have a period of four (4) calendar days upon receipt of the return of the order to check the condition of the products.
For food products and, for reasons of hygiene and health protection, the customer is nevertheless clearly informed that he loses his right of withdrawal for all products that he has unsealed after delivery.
For food products that have been unsealed, given that, for reasons of hygiene and health protection, the right of withdrawal does not apply to these products, Beautysane:
-will in no case proceed to the reimbursement of all payments (including the customer’s transport costs);
-will require the reimbursement of all payments (including the customer’s transport costs) if Beautysane has already proceeded to the reimbursement of all payments received from the customer.

Any product that has been damaged, or whose original packaging has been damaged, will not be refunded or exchanged.

In the event of a problem, Beautysane invites the customer to contact Customer Service directly and solely.

For a return or an exchange, Beautysane invites the customer to contact Customer Service who will indicate the procedure to follow.

Exchange

The exchange is for products delivered in good condition or with a manufacturing defect.
The products must be presented in their original packaging without having been used, with the gifts sent in the order, if any. The exchange will only be for an amount equal to or greater than the original purchase (excluding shipping costs). In the event of a higher amount, the customer will have to make up the difference.

In the event of an anomaly related to the content of the order, Beautysane invites the customer to contact Customer Service directly on 03 69 67 29 00 (cost of a local call).
Any return of product that does not result from the exercise of a guarantee or the right of withdrawal, particularly in case of product defect, must be the subject of a formal agreement between the customer and Beautysane. It will result, where appropriate, the establishment of a credit to the customer. The return costs will be charged to the customer.

Competence

Disputes or disputes that may arise as a result of or in connection with the contract between Beautysane and the customer may be resolved by mediation / conciliation.
Sales of products on this site are subject to French law regardless of the country of residence of the customer or the place of the order. Any dispute relating to the existence, interpretation, execution or termination of a contract between the customer and Beautysane is subject to the exclusive jurisdiction of the French courts.

Confidentiality, protection of personal data & right to object to telephone solicitation
